Abstract

This article discusses a case in which a federal appeals court dismissed a lawsuit alleging that a hospital violated patients’ privacy by sharing electronic health record (EHR) data with Google for medical artificial intelligence (AI) development. The case sheds light on legal challenges hospitals may encounter when collaborating with for-profit companies, even if the data shared are de-identified and do not explicitly identify individual patients. Google partnered with the University of Chicago to develop an AI model using de-identified EHR data from adult patients. While this accelerates medical advancements, it also raises ethical and legal questions.
